Terms of Service (Terms of Use)

These terms govern the rules for using free web applications and generators on the domains nastrojekvality.cz and getqualitytools.com (hereinafter referred to as "Tools").

By using this Website, you explicitly agree to these terms. If you do not agree with any part, you are not authorized to use the Tools.

1. Operator and Purpose of the Service (B2B Only)

• Consumer Exclusion: The Website and Tools are intended exclusively for entrepreneurs, companies, and professionals within their professional activities.
• Waiver of Consumer Rights: By using the Tools, you declare that you are not acting as a consumer and acknowledge that consumer protection provisions do not apply to you.

2. Disclaimer and SLA

• Absolute Exclusion of Damages: The Operator bears no liability for direct, indirect, or consequential damages, lost profits, product defects, production stoppages, or claims arising from decisions made using the Tools. The user bears full responsibility for interpreting the results (e.g., Cpk or 8D).
• Service Availability and Termination: The Operator reserves the right to restrict the service at any time, introduce usage limits, or completely terminate its operation without prior notice and without any right to compensation.

3. Output Rights and Resale Prohibition

• Internal Use Only: The user may use the generated PDF reports and charts exclusively for their internal corporate purposes, process management, or supplier audits.
• Prohibition of Commercial Sale: It is strictly forbidden to commercially sell the generated reports to third parties, include them in paid consulting services as your own product, or use them for direct financial enrichment from providing the outputs themselves.

4. Security and Prohibition of Automated Access

• It is strictly forbidden to automatically extract data from the Tools (web scraping), send a disproportionate number of requests, or attempt to bypass security and capacity limits (Rate Limiting, Cloudflare Turnstile).
• Upon detecting abuse, the Operator reserves the right to immediately and permanently block the user's IP address without giving any reason.

5. Governing Law and Jurisdiction

These terms and all legal relationships arising from them are governed exclusively by the laws of the Czech Republic. The courts of the Czech Republic shall have exclusive jurisdiction to resolve any disputes between the Operator and the user (regardless of their nationality or registered office).
